Compliance guard

The engine has one hard rule and a paper trail: only 40% of the professional fee may be called commission. Everything above that is a Marketing Bonus paid from the agency share, on a real transaction, with documents attached.

Rule 1 — the 40% declaration cap

Declared commission is capped at 40% of the professional fee, net of SST. The engine refuses to save a higher figure — there is no override switch in the interface.

Rule 2 — everything else is a Marketing Bonus

Level commission above 40%, leader override and tier bonuses are paid from the agency share, labeled Marketing Bonus, on its own account code (602-150, kept apart from the declared commission 602-100) — the same wording discipline the IQI vouchers use.

2 Guardrails the engine enforces

Act 242 (estate agency)

  • Only the registered estate agent (or its employees) may be paid — no agent-to-agent payments
  • Declared commission never exceeds 40% of the professional fee
  • Professional fee charged within the scale (rental: 1.25 months gross rental up to 3 years)
  • Written agency agreement on file for every negotiator

Act 500 (anti-pyramid) and tax

  • No joining fee, no entry package, no purchase of stock
  • Every bonus is traceable to a completed property transaction
  • Levels are earned on production, never on the number of recruits
  • Self-billed e-invoice issued before each payout; bank details and TIN on file

Open point for legal review

The structure copies market practice (declared commission plus Marketing Bonus). Because it relies on how the payments are named and documented, it should be reviewed by counsel before the first real payout: if a regulator were to treat the Marketing Bonus as commission, the 40% cap would be exceeded. The control panel therefore carries a switch that moves the whole agency to a single-line payout inside the ceiling if our lawyers advise it.

Rule engine — what the system refuses

These are hard stops, not warnings. Each one refuses the entry and writes the attempt to the audit log, so a rejected configuration can be shown to a regulator or to BOVAEP exactly as it was attempted.
